In compliance with article 10 of Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE), the following general information about the owner of the website orthodata.es and of the BioTrack platform is made available to users and competent authorities.

2. Purpose and scope
This Legal Notice governs the use of the orthodata.es website, its subdomains (including the BioTrack platform available at biotrack.orthodata.es) and any other digital service offered by Orthodata Labs (collectively, the «Services»).
Using the Services confers the status of User and implies full and unreserved acceptance of all the provisions of this Legal Notice, as well as of the Privacy Policy and the Cookie Policy. The User undertakes to make diligent, lawful use in accordance with these terms.
3. Access and use conditions
Access to the website is, as a general rule, free of charge. Access to certain private areas (for example, BioTrack demos or environments for professionals) may require prior registration, a specific contract or an express invitation from Orthodata Labs.
The User undertakes to:
- Not use the Services for unlawful purposes, harmful to the rights of third parties, or that may damage, disable, overload or impair the website or prevent its normal use.
- Not introduce or spread data programs (viruses, malware, scripts) likely to cause damage to the systems of Orthodata Labs, its providers or third parties.
- Provide truthful information when submitting data through forms or enabled channels.
- Respect the intellectual and industrial property rights over the contents.
4. Intellectual and industrial property
All website contents —including, by way of example and without limitation, texts, photographs, graphics, images, icons, technology, software, links, databases, trademarks, trade names, logos and designs— are the property of Orthodata Labs or of third parties who have authorized their use, and are protected by national and international intellectual and industrial property regulations.
In particular, the OrthoData and BioTrack trademarks and associated logos are distinctive signs owned by Orthodata Labs. Their unauthorized use, as well as the total or partial reproduction, distribution, public communication or transformation of the site's contents without the owner's express written authorization, constitutes an infringement of intellectual property rights.
5. Nature of the published information
Content relating to orthobiologic treatments, clinical data collection, PROMs and Real World Evidence is merely informative and professional in nature. It in no case replaces the judgment of a qualified healthcare professional, nor does it constitute medical advice, diagnosis or prescription for end patients.
BioTrack is a clinical-practice support tool aimed at healthcare professionals and authorized entities; its use must comply with the regulations applicable in each jurisdiction and with the specific service contract entered into with Orthodata Labs.
6. Links to third-party sites
The website may contain links to third-party pages (for example, strategic partners, scientific publications or external tools). Orthodata Labs assumes no responsibility for the content, policies or practices of such sites, nor does it guarantee their availability. Access is undertaken at the User's sole responsibility.
7. Exclusion and limitation of liability
Orthodata Labs makes reasonable efforts to ensure the availability, continuity and security of the website, as well as to keep the published information accurate and up to date. However, it does not guarantee the absence of access errors, nor the total absence of viruses or other harmful elements.
Orthodata Labs shall not be liable for damages of any kind that may arise from the lack of availability or continuity of the website, from the failure to meet the usefulness expected by Users, nor from interruptions, delays, errors or omissions caused by circumstances beyond its reasonable control (including, without limitation, failures of telecommunications operators, cloud providers or denial-of-service attacks).
8. Modifications
Orthodata Labs reserves the right to make, at any time and without prior notice, the modifications it deems appropriate to its website, and may change content, configuration, access conditions or any other aspect. Modifications take effect upon publication on the site.
9. Applicable law and jurisdiction
This Legal Notice is governed by Spanish law. For any dispute arising from access to or use of the website, the parties submit, expressly waiving their own jurisdiction, to the Courts and Tribunals of Madrid, unless mandatory applicable regulations provide otherwise (for example, in relation to consumers).
